Are your workers employed or self-employed?

Business owners can learn the latest tax and legal implications of whether their workers are employed or self-employed when experts from Bird Luckin Tax Specialists and Nockolds Solicitors hold a joint presentation at this week’s Bishop’s Stortford Means Business (BSMB) Exhibition.

The issue of employment status has proved a controversial one for employers and workers in recent years, and the outcome of legal cases focusing on these matters can have a major impact on both businesses and individuals.

As a result there are areas that employers need to consider to help determine the true nature of their relationship with those working for them, both from a financial and legal perspective.

Many of these areas will be covered by Bird Luckin Tax Director Peter Warren and Nockolds Managing Partner Darren Hayward, during their ‘Employed or self-employed?’ seminar at the BSMB Exhibition on Wednesday.

Peter will focus on a range of topics including the differences in tax and National Insurance for employees and those self-employed, the relevance of IR35, ways to substantiate self-employed status, whether specific sectors such as construction are treated differently, and the tough HM Revenue and Customs penalties businesses and individuals can face if they get it wrong.

Darren will examine the legal definitions of those who are employees, workers and self-employed, the difference in the legal rights of those three groups, and the implications this can have for both the individual and the business.

Peter explained: “This is a difficult problem, one which has been around for a while but which shows no signs of going away, and which is constantly changing and evolving as cases make their way through the courts.

“The danger is that many people assume they are free to choose whether they are employed or self-employed; but as well as the well-defined employment law aspects which need to be considered, it’s also clear that when it comes to tax and national insurance it is not a matter of personal choice.”

Peter and Darren will jointly present the seminar at 12.30 on Wednesday, as part of a series of essential business seminars at the BSMB Exhibition, which takes place at Rhodes, South Road, Bishop’s Stortford, starting at 10am.
